หากอุทธรณ์ของโจทก์เป็นอุทธรณ์ต้องห้ามอุทธรณ์ในปัญหาข้อเท็จจริง การที่โจทก์มิได้ยื่นคำร้องขอให้ผู้พิพากษาที่พิจารณาหรือลงชื่อในคำพิพากษาอนุญาตให้อุทธรณ์ แต่ผู้พิพากษาที่พิจารณาหรือลงชื่อในคำพิพากษานั้นเป็นผู้ตรวจอุทธรณ์ จะสามารถอนุญาตให้อุทธรณ์ในปัญหาข้อเท็จจริงหรือไม่

รังวัดทำแผนที่พิพาท เป็นค่าฤชาธรรมเนียมตามประมวลกฎหมายวิธีพิจารณาความแพ่ง ซึ่งหากศาลฯสั่งให้ใช้แทนคู่ความอีกฝ่ายหนึ่ง ผู้อุทธรณ์จะต้องนำมาวางศาลพร้อมอุทธรณ์ หรือไม่ และหากศาลชั้นต้น มิได้ระบุค่ารังวัดทำแผนที่พิพาทไว้ในบัญชีค่าฤชาธรรมเนียม จะถือว่าผู้อุทธรณ์จงใจฝ่าฝืนกฎหมายได้หรือไม่
